1722 (b) - To establish a standing independent body to examine all complaints of torture or ill-treatment, excessive use of force or other abuses at the hands of the authorities. The burden of proving that treatment complies with the prohibition of torture and other ill-treatment should be on the State.

Resolutions of the National Commission

Clarifying what is intended by the Permanent Independent Panel of Investigation referred to in Paragraph (B) of Recommendation 1722, and to what extent are the provisions of Recommendations 1716 and 1722 related to other recommendations.

Government Response

The Government of Bahrain shares the Commission’s requirement to provide clarification. Internationally prominent legal jurists were assigned to conduct the study and provide advice on the interpretation of Paragraph 1716. The experts will consider other recommendations including Recommendation 1722(B), to ensure that there is no unnecessary overlapping in implementation. The experts will visit Bahrain during the period 28-29 December 2011.

Providing the National Commission with the actions taken or to be taken in the future to implement this recommendation.

Government Response

The legal experts recommended that the Office of the Attorney General can play the role of "permanent commission." The United Nations Office on Drugs and Crime and the International Institute of Higher Studies on Assistant Criminal Sciences will provide the technology that helps implement this recommendation (see recommendation 1717, and 1722 paragraph (a)).
